Terms of Service

1. Early Access

Kontext is currently in early access. The service is provided as-is, without warranties of any kind — express or implied — including but not limited to warranties of merchantability, fitness for a particular purpose, availability, or non-infringement.

Features, APIs, and data formats may change without notice. We may reset, migrate, or restructure data during the early access period.

2. What Kontext Does

Kontext aggregates and analyzes product feedback from sources you connect (e.g., GitHub, Slack, Intercom, support tools). It uses AI to detect problems, actors, and contexts from that feedback.

You control which data sources are connected and what data flows into Kontext.

3. Your Data

Ownership. You retain ownership of all data you send to Kontext. We do not claim any intellectual property rights over your content.

Your responsibility. You are responsible for ensuring you have the right to share the data you connect to Kontext. This includes customer conversations, support tickets, call transcripts, and any other feedback sources. If your data includes personal information about your users or customers, it is your responsibility to have the appropriate consent or legal basis for sharing it with a third-party service.

Data loss. During early access, we do not guarantee data durability or provide an SLA on data retention. We make reasonable efforts to protect your data, but backups, recovery, and uptime are not guaranteed. You should not rely on Kontext as the sole store of any data.

Deletion. You can request deletion of your data at any time by contacting us. We will delete your data from our systems within a reasonable timeframe, subject to technical limitations (e.g., data already processed by third-party AI providers — see below).

4. AI Processing & Third-Party Providers

Kontext does not ship with default AI provider credentials. No feedback content is sent to any AI provider until you explicitly configure your own API credentials in your organisation settings. Supported providers include:

• OpenAI (US)
• Anthropic (US)
• Mistral (EU, France)
• DeepSeek (China)

When you configure credentials for a provider, the contractual relationship — including data processing terms, model training opt-outs, and acceptable use — exists between you and that provider directly. You are responsible for reviewing their policies:

Kontext does not use feedback content, problem detections, or analysis output to train any model. See our Privacy Policy for full details on AI processing and data transfers.

Infrastructure Providers

Kontext runs on and stores data using third-party infrastructure providers, all hosted in EU regions. The full list is maintained in our Privacy Policy (section 5).

5. Limitation of Liability

To the maximum extent permitted by law:

• Kontext (and its operators) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, business opportunities, or goodwill.
• Our total liability for any claim arising from or related to the service is limited to the amount you paid us in the 12 months preceding the claim, or €100, whichever is greater.
• We are not liable for the accuracy, completeness, or reliability of any AI-generated analysis, classification, or insight produced by the service.

6. Acceptable Use

You agree not to:

• Use Kontext to process data you do not have the right to share.
• Attempt to reverse-engineer, extract, or abuse the AI analysis pipeline.
• Use the service in any way that violates applicable law.

7. Termination

Either party can terminate access at any time, for any reason. We may suspend or terminate your account if we believe you are violating these terms or using the service in a way that puts other users or the platform at risk.

On termination, we will delete your data within a reasonable timeframe unless you request it sooner.

8. Changes to These Terms

We may update these terms as Kontext evolves. We will notify you of material changes via the email associated with your account or through the product. Continued use of the service after changes constitutes acceptance.

9. Governing Law

These terms are governed by the laws of France. Any disputes shall be resolved in the courts of that jurisdiction.
